Terms of Service

PERSONAL INFORMATION

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, subscribe to the newsletter, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, email address. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

CANCELLATION POLICY

You are free to cancel within 72 hours before the picnic with no cancellation fee, you however will be charge for any catering or additional fees I would have already been subject to. Once the picnic has started or been set up (two hours prior to arranged time,) you will be charged the full cost of the picnic including any catering/food and drink provisions.

In the case of a thunder or electrical storm, you must leave immediately for your own safety.

If due to weather, the picnic can not go ahead and we cannot provide alternatives, you will not be charged. 

IDENTIFICATION 

We may ask for photo ID, credit card details or other forms of identification. We can refuse the right to hire or provide our service if you are unable to provide the requested identification or document(s). If we have requested this information it is your responsibility to provide this information immediately.

DEPOSIT 

 

Booking a picnic, gives Noosa Picnics the right to request a deposit. We can refuse the right to hire or provide our service if you are unable to provide the requested deposit. The deposit adheres to the cancellation fee and will be returned in the event of a cancellation prior to 24 hours of the picnic on behalf of the customer. Noosa Picnics has the right to cancel your picnic if deemed unsafe or for reasons within a reasonable scope. If the booking is cancelled within 24 hours of your agreed picnic time, we reserve the right to keep the deposit for our services. 

 


NON-DISCLOSURE

Both parties mutually agree that certain confidential information may be exchanged during the course of this engagement. To ensure the protection of such information and in consideration of the agreement to exchange said information, the parties agree not to disclose the following.

  1. Technical materials, models and relevant technical articles, technical reports owned by either party;

  2. Sales materials, including but not limited to all quality management methods, pricing methods, sales methods and customers’ materials;

  3. All the intellectual property rights (including those exclusively owned by either party, whether owned now or developed in the future); and,

  4. Any other information that either party claims as confidential. The Client agrees that the Agency may, from time to time, share testimonials and results achieved as a result of service provided for marketing purposes. The Client can request that personal and brand information be omitted from case studies and testimonials.

 

​SCOPE OF WORK

The services provided by Noosa Picnics are retainer or performance-based and the Client may avail from the Agency for consultation on the nature, timing and extent of these services either via email, over the telephone, in person, or at Customer’s office

 

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

 

​GOVERNING LAW

 

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia

CHANGES TO TERMS OF SERVICE

 

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
